Statutory Requirement

In accordance with Sections 7 to 11 of the Import and Export Ordinance (Cap. 60 of the Laws of Hong Kong) and Sections 5 to 8 of the Reserved Commodities (Control of Imports, Exports and Reserve Stocks) Regulations (Cap. 296A of the Laws of Hong Kong), shipping companies, airlines and transportation companies:

• must retain and keep custody of the imported "prohibited articles" or "reserved commodities", and shall not deliver them to the importer until valid import licences are produced;
• shall not carry any "prohibited articles" or "reserved commodities" for exportation until valid export licences are produced; and
• must deliver within 14 days after importation/exportation of the "prohibited articles" or "reserved commodities" to the Director-General of Trade and Industry the import/export licences together with the relevant manifests of the vessel, aircraft or vehicle.

Electronic Service on Manifests

Air, ocean, river and rail mode carriers must use electronic service on manifests, and submit the cargo manifests to the Customs and Excise Department, the Census and Statistics Department, and the Trade and Industry Department in one go¹. How to deliver Manifests and Paper Licences/Supporting Documents

Delivery of Road Paper Manifests and Paper Licences/Supporting documents

Please deliver Road paper manifests together with paper licences/supporting documents to Border Control Points at Man Kam To, Lok Ma Chau, Sha Tau Kok, Shenzhen Bay, Hong Kong-Zhuhai-Macao Bridge Hong Kong Port, Lantau or Heung Yuen Wai of Customs and Excise Department when crossing the border.

Delivery of Paper Licences/Supporting Documents for Electronic Manifests

Please deliver paper licences/supporting documents for electronic manifests to the following locations:

Manifest Checking Conducted by the Trade and Industry Department

• The Trade and Industry Department implements a manifest checking system to ensure imports and exports subject to licensing controls are covered by valid import and export licences, and the consignment information and details tally with those contained on the approved import and export licences;
• Manifest checking aims to check whether there are cases of non-compliance with the import and export licensing conditions, for example, overshipment, undershipment, unlicensed importation/exportation and consignment with expired licences.
