(A) TERMS & CONDITIONS OF USE

1. General
1.1 The services ("Services") and information ("Information") on this website are intended for eligible traders who have registered as rough diamond traders with the Trade and Industry Department ("the Department") of the Government of the Hong Kong Special Administrative Region ("the Government") in accordance with the Import and Export Ordinance, Cap. 60 and its subsidiary legislation.
1.2 Rough Diamond Trader Registration Account ("E-Account") holder when making an electronic application for pre-vetting ("E-Application") in his/ her E-Account is further subject to conditions imposed by the Department for such application which may be stipulated in the application and/or announced through circulars published by the Department.
2. Acceptance of Terms and Conditions
2.1 The Department provides the Services and Information through this website, subject to the Terms and Conditions of Use ("T&C") set out herein. The T&C may be updated and revised by the Department from time to time at its absolute discretion.
2.2 Applicants are deemed to have understood, accepted and agreed to be bound by all the T&C upon their use of the Services and/or Information on this website.
3. Provision of Services and Information
3.1 Applicants acknowledge and agree that the Services and Information are provided on an "as is" basis. The Government assumes no responsibility for any untimeliness, deletion or mis-delivery of Information or any failure of Services provided on this website. The Government makes no warranties, representations or statements (whether express or implied) of any kind in relation to the Services and/or Information, including any warranties, representations and statements in respect of the accuracy, completeness, timeliness, merchantability and fitness for any particular purpose of the Services and/or Information.
3.2 Applicants acknowledge and agree that the technical processing and transmission of the Services and/or Information concerned may involve data transmission over various networks, and changes in data format to conform and adapt to technical requirements of connecting networks or devices. The Government shall, in no circumstances, be liable to any person (including without limitation any body of persons, corporate or unincorporated) for any failure of delivery of the Services and/or Information, or any inability to gain access to or use any of the Services and/or Information whether due to the delay or failure of any communication networks or any third party providing such access or otherwise, or any loss or damage (including without limitation any indirect, consequential or special loss or damage such as loss of profit or goodwill) arising out of or in relation to any of the above.
4. Personal Information Collection
4.1 Applicants are required to provide certain personal data in activating and using their E-Account through this website. The data will be used by the Department for facilitating provision of Services and/or Information through the E-Account and ensuring that the E-Account is used by the authentic and eligible user. Applicants providing incomplete or inaccurate data may be denied access to or be rendered ineligible for using any Services and/or Information through this website.
4.2 The Department will take reasonable steps to ensure that all personal data provided through this website are handled in accordance with the relevant provisions of the Personal Data (Privacy) Ordinance, Cap. 486.
4.3 The Department will take reasonable steps to ensure that data collected will be kept in confidence, except that they may be disclosed to other Government departments if such disclosure is necessary to facilitate process of the application, or is authorised or required by the law.

5. Login ID, Password and Security
5.1 Each applicant is required to register online for a Login ID (user name) and a password upon account activation (Note: the login ID and password used for E-Application do not relate to the user login account(s) currently used by the applicant for other e-services (if any) provided through the Department's Web Portal.) Each applicant MUST set the password for its E-Account to be identifiable by the Login ID.
5.2 Applicants shall be solely responsible for maintaining the confidentiality and authorised uses of the Login IDs and the passwords and are fully responsible for all activities that occur in relation to the use of the Login IDs and passwords.
5.3 Applicants agree and acknowledge that the use of the Services and/or Information by any person (whether authorised by the applicants or not) with the passwords shall constitute and be deemed to be the use of the same by the applicants as the account holders.
5.4 The Government shall not be liable for any divulgence of any Login IDs and passwords or loss or damage arising out of or in relation to such divulgence, whether due to the applicant's failure to comply with any of the above conditions or otherwise.
6. Disclaimer of Warranties and Liability
6.1 Applicants acknowledge and agree that the use of the Services and/or Information through this website shall be at their own discretion and risk. The Government shall not be liable for any loss or damage arising out of or in relation to (a) the use of or inability to use the Services and/or Information through this website; and (b) any interruptions or delay in the delivery of or access to the Services and/or Information; and, (c) any unauthorised access to or alteration of the Information, including but not limited to applications and particulars made through this website.
6.2 For the avoidance of doubt, the use of the Services and/or Information including without limitation successful transmission of the E-Application to the Department through this website does not give rise to any rights or expectation that the E-Application concerned will be approved.
