To ensure an adequate and stable supply of powdered formula in Hong Kong for the health of persons aged under 36 months who may still rely heavily on powdered formula, the Import and Export Ordinance (Cap. 60) provides that unless otherwise exempted, or except under and in accordance with a valid Export Licence issued by the Director-General of Trade and Industry, no person/ business shall export powdered formula out of Hong Kong (including by postal arrangement).
"Powdered formula" subject to the export licensing control and as defined under Regulation 2 of the Import and Export (General) Regulations (Cap. 60, subsidiary legislation A) means a substance in powder form that -
- is or appears to be for consumption by a person aged under 36 months; and
- is or appears to be milk or milk-like substance in powder form to satisfy wholly or partly the nutritional requirement of a person aged under 36 months.
