Rough Diamond Trader Registration Circular No. 13/2003

Import and Export of Rough Diamonds :
Expeditious and Instant Certification Services

Introduction

This circular informs traders that they may make use of the expeditious and instant certification services which have been in operation. For re-export of rough diamonds, traders may make their applications for Kimberley Process (KP) Certificate (Import) and Kimberley Process (KP) Certificate (Export) simultaneously and obtain the KP Certificates in shorter turnaround time than if the two applications are made separately. Moreover, to facilitate traders who may have urgent needs to obtain KP Certificates, traders may request instant certification service for their KP Certificates.

The Certification Scheme

  1. Under the Import and Export Ordinance (Cap 60) and its subsidiary legislation, unless otherwise exempted by the Director-General of Trade and Industry (the Director), import and export of rough diamonds must be covered by valid KP Certificate (Import) and KP Certificate (Export) respectively issued by the Director. Under normal circumstances, the KP Certificate, if approved, will be ready for collection by traders on the following working day after the application is received for processing.

Details of Expeditious Service for Re-export

  1. The expeditious certification service for re-export of rough diamonds facilitates traders to obtain their KP Certificate (Import) and KP Certificate (Export) efficiently when they already have the export information at the time when the rough diamonds are imported. Where the application for KP Certificate (Import) and KP Certificate (Export) are lodged simultaneously, traders do not have to prepare a photocopy of the relevant KP Certificate (Import) as supporting document for the KP Certificate (Export). The KP Certificates, if approved, will be ready for collection by traders on the following working day after the application is received for processing.

Details of Instant Certification Service

  1. To facilitate traders who may have genuine needs to obtain their KP Certificates urgently, under special consideration and as far as practicable, we may entertain instant processing of applications for KP Certificates. Requests for instant processing must be supported by acceptable reasons. Traders are advised to make such request in the form of a request letter or make use of the request form at Appendix (pdf format) and support their request by documents evidencing the unforeseen urgency. Normally, the processing time for each application is about 30 minutes. The processing time may be longer during peak hours. A trader making more than one application at a time may also expect longer processing time.
     

  2. Since instant processing is expected to be needed on exceptional circumstances, the service may be suspended in respect of traders who have been found to have made use of the service more frequently than is considered reasonable. In general, not more than five requests from each trader will be entertained during any one month. The Director at all times reserves the right to determine, whether, in any case, the reasons given to support a request for instant service are acceptable and the frequency involved is reasonable.

Important Note

  1. Traders should note that the Department's acceptance of the requests for expeditious processing or instant processing does not imply automatic approval of the KP Certificates. The applications will be processed according to normal criteria. Failure to comply with the certification requirements and arrangements will result in deferment or rejection of the application concerned.
