Notice to Exporters: Series 2 (EU) No. 7/2011

European Union (EU)* : Proof of Origin for Import of Certain Textiles and Clothing Products into the EU

The European Parliament (EP) and the Council of the EU have adopted a new Regulation to repeal the current proof of origin requirement for textiles and clothing (T&C) products imported into the EU from 24 October 2011. The Regulation (EU) No 955/2011 published on 4 October 2011 is accessible from the EU website at :

DETAILS

2.At present, Council Regulation (EC) No 1541/98 stipulates the rules on proof of origin for certain T&C products imported into the EU. The imports must be accompanied by either a certificate of origin or an origin declaration on commercial invoices depending on the product category for customs clearance. On 4 October 2011, a new Regulation (EU) No 955/2011 was promulgated to repeal Regulation (EC) No 1541/98. In this connection, T&C products imported into the EU will no longer be subject to the proof of origin requirement in the form of certificate of origin or origin declaration on commercial invoices with effect from 24 October 2011.

3.Traders are reminded that EU still requires the indication of the country/place of origin of imported products in the customs declaration. Such indication is subject to the EU's normal verification procedures, which include the possibility for the customs authorities to require additional proof, where appropriate, on a case-by-case basis.

4.Commercial Information Circular No. 316/2004 cum Notice to Exporters: Series 2 (EU) No. 37/2004 dated 13 December 2004 and Commercial Information Circular No. 52/2005 cum Notice to Exporters: Series 2 (EU) No. 3/2005 dated 16 February 2005 are hereby superseded.
