Commercial Information Circular No. 278/2024

European Union (EU)* : Imposition of a provisional anti-dumping duty on imports of certain alkyl phosphate esters originating in the Mainland of China

Further to Commercial Information Circular No. 572/2023 of 11 August 2023, the European Commission published Implementing Regulation (EU) 2024/1064 on 10 April 2024 to impose a provisional anti-dumping duty on imports of certain alkyl phosphate esters originating in the Mainland of China. 2.Salient points of the Regulation are set out below -

(a) Product : Certain alkyl phosphate esters based exclusively on side chains with a length of two or three carbon atoms (also includes chlorinated alkyl chains) and with a phosphorus content of at least 9% (per weight) and a viscosity between 1 and 100 mPa·s (at 20-25°C) falling under Chemical Abstracts Service numbers 13674-84-5, 1244733-77-4 and 78-40-0, currently falling under CN code ex 2919 90 00 (TARIC codes 2919900050 and 2919900065) and CN code ex 3824 99 92 (TARIC code 3824999238) and originating in the Mainland of China
(b) Rate of duty : 68.4% of the net, free-at-Union-frontier price before duty (except for a number of companies with individual duty rates from 45.1% to 63.0%)
(c) Effective date : 11 April 2024 (the duty will apply for six months)
(d) Collection of duty : The release for free circulation in the EU of the product shall be subject to the provision of a security deposit equivalent to the amount of the provisional duty.

3.For traders involved in the exports of the subject product from the Guangdong Province, please contact ZHENG Jingmin, Director of Trade Remedy and Industry Injury Investigation Division under the Department of Commerce of Guangdong Province, at 86 20 3881 9797. The Division is responsible for, among others, guiding and coordinating enterprises in Guangdong Province in responding to anti-dumping investigations against products from the province.
