Commercial Information Circular No. 961/2022

European Union (EU)* : Reopening of absorption reinvestigation concerning anti-dumping measures on imports of optical fibre cables originating in the Mainland of China

Further to the Commercial Information Circular No. 254/2022 of 25 March 2022, the European Commission published a notice 2022/C 467/06 on 8 December 2022 on the reopening of absorption reinvestigation concerning the anti-dumping measures on imports of optical fibre cables originating in the Mainland of China. 2.The product concerned are single mode optical fibre cables, made up of one or more individually sheathed fibres, with protective casing, whether or not containing electric conductors, currently falling under CN code ex 8544 70 00 (TARIC code 8544 70 00 10) and originating in the Mainland of China. The following products are excluded: (i) cables in which all the optical fibres are individually fitted with operational connectors at one or both extremities; and (ii) cables for submarine use (i.e. plastic insulated optical fibre cables, containing a copper or aluminium conductor, in which fibres are contained in metal module(s)).

3.The reinvestigation will determine whether after the original investigation period and prior to or following the imposition of measures, export prices have decreased or that there has been no movement, or insufficient movement, in the resale prices or subsequent selling prices of the imported product in the EU.

4.To enable the Commission to decide whether sampling is necessary, and if so, to select a sample, all producers in the Mainland of China, or representatives acting on their behalf are requested to provide the Commission with information on their company(ies) within 7 days from 8 December 2022. The information must be provided via TRON.tdi at: https://tron.trade.ec.europa.eu/tron/tdi/form/R785_SAMPLING_FORM_FOR_EXPORTING_PRODUCER.

5.All interested parties may make their views known, submit information and provide supporting evidence within 37 days from 8 December 2022, unless otherwise specified. They may request to be heard by the Commission investigation services. A request for hearing with or intervention of the Hearing Officer, who reports directly to the Commissioner for Trade of the EU, may also be made. Hearing requests should be made in writing, specifying the reasons for the request, at the earliest possible time.

6.For traders involved in the exports of the subject product from the Guangdong Province, please contact ZHENG Jingmin, Director of Trade Remedy and Industry Injury Investigation Division under the Department of Commerce of Guangdong Province, at 86 20 3881 9797. The Division is responsible for, among others, guiding and coordinating enterprises in Guangdong Province in responding to anti-dumping investigations against products from the province.
