European Union (EU)* : Result of New Exporting Producer's Request under the Anti-dumping Measures on Imports of High Tenacity Yarn of Polyesters Originating in the Mainland of China

Further to Commercial Information Circular No. 192/2017 of 14 March 2017, the European Commission ("the EC") has published a regulation announcing the decision to grant "New Exporting Producer Treatment" ("NEPT") to a Mainland company named Wuxi Solead Technology Development Co., Ltd, under the anti-dumping measures on imports of high tenacity yarn of polyesters originating in the Mainland of China. DETAILS

2.Salient points of the treatment for the aforesaid company are set out below -

(a) Company Name : Wuxi Solead Technology Development Co., Ltd,
(b) Product Coverage : High tenacity yarn of polyesters (other than sewing thread), not put up for retail sale, including monofilament of less than 67 decitex, originating in the Mainland of China, currently falling within CN code 5402 20 00
(c) Rate of Duty : 5.3% of the net, free-at-Union-frontier price before duty
(d) Effective Date : 12 October 2019

BACKGROUND

3.In accordance with Council Implementing Regulation (EU) No 1105/2010 of 29 November 2010, definitive anti-dumping duty on imports of high tenacity yarn of polyesters originating in the Mainland of China has been imposed since 2 December 2010. The duty rate is set at 9.8% of the net, free-at-Union-frontier price before duty (except for 13 companies with individual duty rates ranging from 0% to 9.8%). Subsequently, the EC initiated an expiry review of the anti-dumping measures on 28 November 2015 and decided, after the expiry review, to maintain the definitive anti-dumping duty for five years with effect from 26 February 2017 in accordance with the Implementing Regulation (EU) 2017/325 ("the Regulation").

4.The aforesaid company requested to be granted NEPT under Article 1 (5) of the Regulation. The verification by the EC showed that the company had provided sufficient evidence to prove that it meets the criteria to be considered as a new exporting producer. It could therefore be granted the weighted average duty rate for the cooperating companies not included in the sample (i.e. 5.3%) and added to the list of cooperating companies not included in the sample in Annex to the Regulation.
