European Union (EU)* : Extension of the definitive anti-dumping measures imposed on imports of citric acid originating in the Mainland of China to imports of citric acid consigned from Malaysia, whether declared as originating in Malaysia or not

Further to Commercial Information Circular No. 315/2015 of 4 May 2015, the European Commission (the Commission) has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of citric acid originating in the Mainland of China to imports of citric acid consigned from Malaysia, whether declared as originating in Malaysia or not. DETAILS

2.Following a circumvention investigation initiated in May 2015, the Commission has adopted the implementing regulation to extend, with effect from 16 January 2016, the definitive anti-dumping duty imposed on imports of citric acid originating in the Mainland of China, currently falling within CN codes ex 2918 14 00 (TARIC code 2918 14 00 10) and ex 2918 15 00 (TARIC code 2918 15 00 11), to imports of the same products consigned from Malaysia, whether declared as originating in Malaysia or not.

3.The implementing regulation also specifies that the extended duty will be collected on registered imports consigned from Malaysia, whether declared as originating in Malaysia or not.

4.Imports from companies which do not circumvent the anti-dumping measures imposed by Regulation (EU) No 791/2011 may be exempted from the duty extended by the implementing regulation. Requests for exemption shall be made in writing in one of the official languages of the EU, including English, and must be signed by a person authorised to represent the applicant. The request must be sent to the following address:

5.With the extension of the anti-dumping duty, the registration of imports established in accordance with the Commission's regulation of May 2015 will be discontinued.

BACKGROUND

6.Definitive anti-dumping duty on imports of citric acid originating in the Mainland of China has been imposed since 4 December 2008 and the duty in force is 42.7% of the net, free-at-Union-frontier price before duty (except for a number of companies with individual duty rates from 15.3% to 42.7%).
