Commercial Information Circular No. 674/2016

European Union (EU)* : Withdrawal of the acceptance of the undertaking for five exporting producers offered in connection with the anti-dumping and anti-subsidy proceedings concerning imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China

Further to Commercial Information Circulars Nos. 970/2013 and 971/2013 of 5 December 2013, the European Commission (the Commission) has published an implementing regulation, which entered into force on 18 August 2016, to withdraw the acceptance of the undertaking for five exporting producers offered in connection with the anti-dumping and anti-subsidy proceedings concerning imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China. 2.The exporting producers are -

  1. Delsolar (Wujiang) Ltd together with its related company in the EU, jointly covered by the TARIC additional code B792;
  2. MOTECH (Suzhou) RENEWABLE ENERGY CO. LTD covered by the TARIC additional code B852;
  3. CNPV Dongying Solar Power Co. Ltd covered by the TARIC additional code B813;
  4. Xi'an LONGi Silicon Materials Corp. and Wuxi LONGi Silicon Materials Co. Ltd, jointly covered by the TARIC additional code B897; and
  5. LERRI Solar Technology (Zhejiang) Co. Ltd together with its related company in the EU, jointly covered by the TARIC additional code B898.
The Commission concluded that the monitoring of the undertaking for exporting producers (a) and (b) was no longer practicable.  On the other hand, exporting producers (c), (d) and (e) notified the Commission that they wished to withdraw from the undertaking.  The Commission has therefore concluded that the acceptance of the undertaking for the five exporting producers shall be withdrawn.
