Commercial Information Circular No. 540/2016

European Union (EU)* : Withdrawal of the acceptance of an undertaking for one exporting producer offered in connection with the anti-dumping and anti-subsidy proceedings concerning imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China

Further to Commercial Information Circulars Nos. 970/2013 and 971/2013 of 5 December 2013, the European Commission (the Commission) has published an implementing regulation to withdraw the acceptance of an undertaking for an exporting producer offered in connection with the anti-dumping and anti-subsidy proceedings concerning imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China for the period of application of definitive measures. The implementing regulation is available at:

2.While monitoring compliance with the undertaking, Zhejiang Xiongtai Photovoltaic Technology Co. Ltd (Shinetime China) and its related company in the EU, SHINETIME SOLAR GMBH (Shinetime Europe) were found to have breached the undertaking by selling below the minimum import price. The Commission has therefore concluded that the acceptance of the undertaking for Shinetime China and Shinetime Europe, jointly covered by the TARIC additional code B919, shall be withdrawn. The implementing regulation entered into force on 30 June 2016.
