Commercial Information Circular No. 43/2016

European Union (EU) * : Termination of the partial interim review of the anti-dumping and countervailing measures on imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China

Further to Commercial Information Circular No. 322/2015 of 6 May 2015, the European Commission (the Commission) has published an implementing regulation to terminate the partial interim review of the anti-dumping and countervailing measures on imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China. DETAILS

2.On the basis of a request lodged by EU ProSun ('the applicant'), the Commission initiated an investigation on 5 May 2015 to ascertain whether the existing benchmark, which has been used as reference for the minimum import price adaptation mechanism, is still representative of the development of module prices, and therefore still fulfils its objective as set out in the measures in force.

3.The Commission has now completed the investigation and terminated the partial interim review as the existing benchmark remains representative of the development of worldwide module prices and therefore still fulfils its objective as set out in the measures in force. The implementing regulation shall enter into force on 8 January 2016.

BACKGROUND

4.Definitive anti-dumping duty on imports of the product had been imposed since 6 December 2013 at a rate of 53.4% of the net, free-at-Union-frontier price, before duty (except for a number of companies with individual duty rates from 27.3% to 64.9%). Apart from the definitive anti-dumping duty, the Council has also imposed a definitive countervailing duty on imports of the product since 6 December 2013 and the duty in force is 11.5% of the net, free-at-Union-frontier price before duty (except for a number of companies with individual duty rates from 0.0% to 11.5%).
