Dear Sirs,

Commercial Information Circular No. 430/2016

European Union (EU)* : Withdrawal of the acceptance of the undertaking for two exporting producers offered in connection with the anti-dumping proceeding concerning imports of citric acid originating in the Mainland of China

Further to Commercial Information Circular No. 89/2015 of 23 January 2015, the European Commission (the Commission) has published an implementing regulation to withdraw the acceptance of the undertaking offered in connection with the anti-dumping proceeding concerning imports of citric acid originating in the Mainland of China.  The implementing regulation can be accessed through the following link:
http://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:32016R0704&from=EN.

DETAILS

2.   While monitoring compliance with the undertaking, two exporting producers were found to have breached a number of terms of the undertaking. The Commission therefore decides to withdraw the acceptance of the undertaking in relation to (i) Weifang Ensign Industry Co., Ltd covered by TARIC additional code A882, (ii) TTCA Co., Ltd covered by TARIC additional code A878, together with the China Chamber of Commerce of Metals, Minerals and Chemicals Importers and Exporters (the parties).

3.     The implementing regulation entered into force on 13 May 2016.

BACKGROUND

4.          Definitive anti-dumping duty on imports of citric acid originating in the Mainland of China has been imposed since 4 December 2008 and the duty in force is 42.7% of the net, free-at-Union-frontier price, before duty (except for a number of companies with individual duty rates from 15.3% to 42.7%).  In connection with the proceeding, the Commission accepted the undertaking offered, inter alia, by the parties.

5.     Consequent to an expiry review and some partial interim reviews, the anti-dumping duty has been maintained for another five years with effect from 23 January 2015.  From 16 January 2016 the duty has been extended to imports consigned from Malaysia, regardless of whether they are declared as originating in Malaysia or not, following a circumvention investigation.
