European Union (EU)* : Repeal of the anti-dumping duty on imports of certain iron or steel fasteners originating in the Mainland of China, as extended to imports of certain iron or steel fasteners consigned from Malaysia, whether declared as originating in Malaysia or not

Further to Commercial Information Circular No. 229/2015 of 30 March 2015, the European Commission (the Commission) has published an implementing regulation to repeal the anti-dumping duty on imports of certain iron or steel fasteners originating in the Mainland of China, as extended to imports of certain iron or steel fasteners consigned from Malaysia, whether declared as originating in Malaysia or not, and to terminate the proceeding concerning these imports.  The implementing regulation can be accessed through the following link:

2.     In gist, following a series of consultations and appeals by the Mainland of China and the EU since 2013 regarding the consistency between the subject anti-dumping measures and the Anti-Dumping Agreement and the General Agreement on Tariffs and Trade 1994, the World Trade Organisation (WTO) Appellate Body has released its latest findings and made an recommendation to the WTO Dispute Settlement Body on 18 January 2016.  In view of the findings, the Commission considered that it is appropriate to repeal the anti-dumping duty, which took effect on 28 February 2016.

BACKGROUND

3.Definitive anti-dumping duty on certain iron or steel fasteners originating in the Mainland of China has been imposed since 1 February 2009. Consequent to a circumvention investigation, the anti-dumping duty has been extended with effect from 27 July 2011 to imports of the same products consigned from Malaysia, regardless of whether they are declared as originating in Malaysia or not. As a result of two reviews initiated in March 2012 and June 2012, the applicable rate of the definitive anti-dumping duty has been amended to 74.1% of the net, free-at-Union-frontier price before duty (except for a number of companies whose individual duty rates range from 0% to 69.7%).  Consequent to an expiry review completed in March 2015, the Commission has maintained the definitive anti-dumping duty.
