Commercial Information Circular No. 220/2016

European Union (EU) * : Imposition of a provisional anti-dumping duty on imports of aspartameoriginating inthe Mainland of China

Further to Commercial Information Circular No. 440/2015 of 1 June 2015, the European Commission (the Commission) has published a regulation to impose a provisional anti-dumping duty on imports of aspartameoriginating in the Mainland of China. The regulation can be accessed through the following link:

DETAILS

2.Salient points are set out below:

(a) Product :
Aspartame (N-L-α-Aspartyl-L-phenylalanine-1-methyl ester, 3-amino-N-(α-carbomethoxy-phenethyl)-succinamic acid-N-methyl ester), CAS RN 22839-47-0, originating in the Mainland of China, currently falling within CN code ex 2924 29 98 (TARIC code 2924 29 98 05)
 
(Note: The Commission concluded that due to the lack of relevant imports during the investigation period, preparations and mixtures containing aspartame from the Mainland of China should not be included in the definition of the product scope.)
(b) Rate of Duty :
59.4% on the CIF Union border price, customs duty unpaid
(except for a number of companies with individual duty rates from 55.4% to 59.4%)
(c) Effective Date :
27 February 2016 (the duty will apply for sixmonths)
(d) Collection of Duty : The release for free circulation in the EU of the product shall be subject to the provision of a security deposit equivalent to the amount of the provisional duty
(e) Time Limit for Comments
: Interested parties may request disclosure of the essential facts and considerations on the basis of which the regulation was adopted, make their views known in writing, orrequest to be heard by the Commission and/or the Hearing Officer within 25 days from 27 February 2016.
