European Union (EU)* : Public online consultation concerning a possible change in the methodology to establish dumping in trade defence investigations concerning the Mainland of China

The European Commission (the Commission) has launched an online public consultation concerning a possible change in the methodology to establish dumping in trade defence investigations concerning the Mainland of China.

2.Under its Protocol of Accession to the World Trade Organization of 2001 (the Protocol), the Mainland of China is not considered a market economy in anti-dumping proceedings. As a result, the EU anti-dumping rules generally use prices or costs from an "analogue country" to calculate the level of alleged dumping of products originating in the Mainland of China. Certain provisions of the Protocol on "Price Comparability in determining Subsidies and Dumping" will expire on 11 December 2016. The Commission is analysing possible impact of this impending expiry on the EU anti-dumping legislation.

3.The consultation, which is part of the Commission's impact assessment, aims to ensure that all relevant stakeholders have an opportunity to give their opinion on the options under consideration. The online consultation can be accessed through the following link:
