Dear Sirs,

Commercial Information Circular No. 725/2015

European Union (EU)* : Restriction of the use of ammonium salts in cellulose wadding insulation materials

Further to Commercial Information Circular No. 859/2013 dated 29 October 2013, the European Commission has adopted a Decision to amend Decision 2013/505/EU authorizing the provisional measure taken by the French Republic concerning the restriction of the use of ammonium salts in cellulose wadding insulation materials. Details are set out in Commission Implementing Decision (EU) 2015/1131, which can be accessed through the following link:
http://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:32015D1131&from=EN

DETAILS

2.Decision 2013/505/EU authorizes the provisional measure taken by the French Republic concerning the restriction of the use of ammonium salts in cellulose wadding insulation materials for a time period of 21 months beginning on 15 October 2013, which will end on 14 July 2015. Owing to the unforeseen difficulties relating to the conformity check carried out on the dossier in accordance with Regulation (EC) No. 1907/2006, the restriction procedure has been delayed and will probably not conclude before spring 2016. In order to avoid the legal uncertainty that would result from the expiry of the authorization of the French provisional measure before the conclusion of the restriction procedure, it is necessary to extend the time period for which the provisional measure is authorized. Thus, the time period "21 months" specified in Decision 2013/505/EU is replaced by "36 months".
