European Union (EU)* : Extension of the definitive anti-dumping measures imposed on imports of bicycles originating in the Mainland of China to imports of bicycles consigned from Cambodia, Pakistan and the Philippines, whether declared as originating in Cambodia, Pakistan and the Philippines or not

Further to Commercial Information Circulars Nos. 805/2014 of 4 September 2014 and 1026/2014 of 28 November 2014, the European Commission (the Commission) has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of bicycles originating in the Mainland of China to imports of bicycles consigned from Cambodia, Pakistan and the Philippines, whether declared as originating in Cambodia, Pakistan and the Philippines or not. DETAILS

2. Following a circumvention investigation initiated in September 2014, the Commission has adopted the implementing regulation to extend, with effect from 20 May 2015, the definitive anti-dumping duty imposed on imports of bicycles and other cycles (including delivery tricycles, but excluding unicycles), not motorised, originating in the Mainland of China to imports of the same products consigned from Cambodia, Pakistan and the Philippines whether declared as originating in Cambodia, Pakistan and the Philippines or not, currently falling within CN codes ex 8712 00 30 and ex 8712 00 70 (TARIC codes 8712 00 30 20 and 8712 00 70 92), with the exception of those produced by a number of companies of the Philippines and Cambodia as listed in the implementing regulation.
 
3. The implementing regulation also specifies that the extended duty will be collected on registered imports consigned from Cambodia, Pakistan and the Philippines, whether declared as originating in Cambodia, Pakistan and the Philippines or not.
 
4. Imports from companies which do not circumvent the anti-dumping measures imposed by Regulation (EU) No 502/2013 may be exempted from the duty extended by the implementing regulation.  Requests for exemption shall be made in writing in one of the official languages of the EU, including English, and must be signed by a person authorised to represent the applicant. 5. With the extension of the anti-dumping duty, the registration of imports established in accordance with the Commission's regulation of September 2014 will be discontinued.

BACKGROUND

6. Definitive anti-dumping duty on imports of bicycles originating in the Mainland of China has been imposed since 10 September 1993.  Based on the findings of a circumvention investigation, the definitive anti-dumping duty has been extended to imports of certain bicycle parts originating in the Mainland of China from 19 January 1997.  The duty was also extended, for five years on each occasion, in July 2000, July 2005 and October 2011 as a result of the expiry or interim reviews conducted.
 
7. Consequent to another circumvention investigation, the anti-dumping duty has been extended to imports of bicycles consigned from Indonesia, Malaysia, Sri Lanka and Tunisia, whether declared as originating in Indonesia, Malaysia, Sri Lanka and Tunisia or not, with effect from 6 June 2013. Following another interim review, the rate of definitive anti-dumping duty has been amended to 48.5% of the net, free-at-Union-frontier price before duty (except for a number of companies whose individual duty rates range from 0% to 19.2%) with effect from 6 June 2013.  The Commission initiated an investigation concerning the possible circumvention of anti-dumping measures imposed on imports of bicycles originating in the Mainland of China on 2 September 2014.
