European Union (EU)* : Amendment to the Council Implementing Regulation Imposing a Definitive Anti-dumping Duty and Collecting Definitively the Provisional Duty Imposed on Imports of Solar Glass Originating in the Mainland of China

Further to Commercial Information Circular Nos. 450/2014 and 451/2014 of 15 May2014, the European Commission (the Commission) has published an implementing regulation to amend the Commission Implementing Regulation (the original Regulation) imposing a definitive anti-dumping duty and collecting definitively the provisional duty imposed on imports of solar glass originating in the Mainland of China. The Regulation can be accessed through the following link:

DETAILS

2.According to the Regulation, three of the cooperating non-sampled companies, which cooperated in the anti-dumping investigation, did not cooperate in the parallel anti-subsidy investigation. For that reason their definitive anti-subsidy duty rate was determined at 17.1%. It follows that the individual dumping duty rates for these three companies should be adjusted to 19.4%.

3.The Regulation shall enter into force on 16 April 2015 and apply retroactively from 15 May 2014.

BACKGROUND

4.The Commission adopted the original Regulation imposing definitive anti-dumping duty and an implementing regulation imposing definitive countervailing duty on solar glass originated in the Mainland of China in May 2014. The injury elimination level applicable to "cooperating non-sampled companies" was determined at 36.5%. Pursuant to the original Regulation, in parallel investigations where the subsidy margins are lower than the injury elimination level, the definitive anti-dumping duty should be imposed up to the relevant injury elimination level.
