European Union (EU)* : Amendment to the Council Implementing Regulation Imposing a Definitive Anti-dumping Duty and Collecting Definitively the Provisional Duty Imposed on Imports of Ceramic Tiles Originating in the Mainland of China

Further to Commercial Information Circulars No. 109/2014 of 4 February 2014, the European Commission (the Commission) has published an implementing regulation to amend the Council Implementing Regulation (the original Regulation) imposing a definitive anti-dumping duty and collecting definitively the provisional duty imposed on imports of ceramic tiles originating in the Mainland of China. DETAILS

2.Upon receipt of a request for a partial interim review from exporting producers from the Mainland of China, Foshan Gani Ceramic Co., Ltd and Qingyang Gani Ceramic Co., Ltd (Gani Group), the Commission published a notice on 31 January 2014 to initiate an investigation limited in scope to the examination of the ownership structure of the Gani Group and, if warranted, ex officio of the dumping margin as far as the Gani Group was concerned.The review also covered ex officio the same matters as far as Dongguan City Wonderful Ceramics Industrial Park Co., Ltd and Guangdong Jiamei Ceramics Co., Ltd (Wonderful Group) was concerned.

3.In light of the findings of the investigation, the Commission concluded that there were no indications that the Gani Group and the Wonderful Group would have any other structural or corporate links. Accordingly, the change of the relationship between the two groups was accepted as claimed and the Gani Group and the Wonderful Group were considered no longer related for the purposes of specifying the duty. Hence, the Commission has adopted the amending implementing regulation by replacing the single duty rate (26.3%) in the original Regulation, which was applicable to the two groups, with individual duty rates of 13.9% and 32% for the Gani Group and the Wonderful Group respectively.

4. The amending implementing regulation shall enter into force on 13 March 2015.

BACKGROUND

5. Definitive anti-dumping duty on imports of ceramic tiles originating in the Mainland of China has been imposed since 16 September 2011.The current duty in force is 69.7% of the net, free-at-Union-frontier price before duty (except for a number of companies whose individual duty rates range from 13.9% to 36.5%).
