European Union (EU)* : Extension of the definitive anti-dumping measuresimposed on imports of certain Molybdenum wiresoriginating in the Mainland of China to imports of certain slightly modified Molybdenum wires originating in the Mainland of China

Further to Commercial Information Circular No. 189/2015 of 12 March 2015, the European Commission (the Commission) has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of certain Molybdenum wires originating in the Mainland of China to imports of certain slightly modified Molybdenum wires originating in the Mainland of China. DETAILS

2.Following a circumvention investigation initiated in March 2015, the Commission has adopted the implementing regulation to extend, with effect from 31 October 2015, the definitive anti-dumping duty imposed on imports of molybdenum wire, containing by weight at least 99.95 % of molybdenum, of which the maximum cross-sectional dimension exceeds 1.35 mm but does not exceed 4.0 mm, originating in the Mainland of China to imports of molybdenum wire, containing by weight at least 97 % of molybdenum, of which the maximum cross-sectional dimension exceeds 4.0 mm but does not exceed 11.0 mm, originating in the Mainland of China, currently falling within CN codes ex 8102 96 00 (TARIC codes 8102 96 00 20 and 8102 96 00 40).

3.The implementing regulation also specifies that the extended duty will be collected on registered imports into the Union of molybdenum wire, currently falling within CN codes ex 8102 96 00 (TARIC codes 8102 96 00 20 and 8102 96 00 40).

4.Imports from companies which do not circumvent the anti-dumping measures imposed by Regulation (EU) No 502/2013 may be exempted from the duty extended by the implementing regulation. Requests for exemption shall be made in writing in one of the official languages of the EU, including English, and must be signed by a person authorised to represent the applicant. 5.With the extension of the anti-dumping duty, the registration of imports established in accordance with the Commission's regulation of March 2015 will be discontinued.

BACKGROUND

6.Definitive anti-dumping duty on imports of molybdenum wire, containing by weight at least 99.95 % of molybdenum, of which the maximum cross-sectional dimension exceeds 1.35 mm but does not exceed 4.0 mm, originating in the Mainland of China has been imposed since 17 June 2010. Based on the findings of a circumvention investigation, the definitive anti-dumping duty has been extended to imports consigned from Malaysia, whether declared as originating in Malaysia or not, with effect from 13 January 2012.

7.Consequent to another circumvention investigation, the anti-dumping duty has been extended to imports of molybdenum wires, containing by weight at least 97% of molybdenum, with the same dimension with effect from 13 September 2013. The Commission initiated an expiry review on 12 June 2015.
