European Union (EU)* : Extension of the Definitive Anti-dumping Measures Imposed on Imports of Certain Open Mesh Fabrics of Glass Fibres Originating in the Mainland of China to Imports of Certain Slightly Modified Open Mesh Fabrics of Glass Fibres Originating in the Mainland of China

Further to the Commercial Information Circular No. 1026/2013 of 18 December 2013, the European Commission (the Commission) has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China to imports of certain slightly modified open mesh fabrics of glass fibres originating in the Mainland of China. DETAILS

2.The European Commission (the Commission) published Regulation (EU) No 1356/2013 on 18 December 2013 to initiate an investigation concerning the possible circumvention of anti-dumping measures imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China by imports of certain slightly modified open mesh fabrics of glass fibres originating in the Mainland of China. The regulation also made imports of open mesh fabrics of glass fibres, of a cell size of more than 1.8 mm both in length and in width and weighing more than 35 g/m2, excluding fibreglass discs, originating in the Mainland of China, falling within CN code ex 7019 40 00 (TARIC codes 7019 40 00 11, 7019 40 00 21 and 7019 40 00 50) subject to registration by the EU's customs authorities.

3.Following the circumvention investigation, the Council has adopted the implementing regulation to extend, with effect from 17 September 2014, the existing definitive anti-dumping duty imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China to imports of open mesh fabrics of glass fibres, of a cell size of more than 1.8 mm both in length and in width and weighing more than 35 g/m2, excluding fibreglass discs, falling within CN code ex 7019 40 00 (TARIC codes 7019 40 00 11, 7019 40 00 21 and 7019 40 00 50) and originating in the Mainland of China.

4.The implementing regulation also specifies that the extended duty will be collected on imports of the open mesh fabrics of glass fibres originating in the Mainland of China registered in accordance with Regulation (EU) No 1356/2013.

5.Meanwhile, with the extension of the anti-dumping duty, the registration of imports established in accordance with Regulation (EU) No 1356/2013 will be discontinued.

BACKGROUND

6.Definitive anti-dumping duties on certain open mesh fabrics of glass fibres originating in the Mainland of China have been imposed since 10 August 2011. The current duty in force is 62.9% of the net, free-at-Union-frontier price, before duty (except for a number of companies whose individual duty rates range from 48.4% to 62.9%). Consequent to three separate circumvention investigations, the definitive anti-dumping duties have previously been extended to imports of certain open mesh fabrics of glass fibres consigned from Malaysia, regardless of whether they are declared as originating in Malaysia or not (since 25 July 2012); from Taiwan and Thailand, regardless of whether they are declared as originating in Taiwan and Thailand or not (since 17 January 2013); and from India and Indonesia regardless of whether they are declared as originating in India and Indonesia or not (since 21 December 2013).
