European Union (EU)* : Results of "New Exporter" Review of the Anti-dumping Measures on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to the Commercial Information Circular No. 60/2014 of 15 January 2014, the European Commission (the Commission) has promulgated an implementing regulation to impose a definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China and manufactured by a Chinese exporting producer. DETAILS

2.The Commission initiated in January 2014 a "new exporter" review at the request of a Chinese exporting producer, Ningbo Logitrans Handling Equipment Co., Ltd. (the applicant), claiming, inter alia, that it had begun exporting the concerned product to the Union only after the end of the original investigation period on which the anti-dumping measures were based and the investigation period of a subsequent interim review investigation. Simultaneously, the anti-dumping duty in force was repealed with regard to imports of the concerned product produced and sold for export to the Union by the applicant, while customs authorities of the Union were directed to take appropriate steps to register such imports.

3.Existence of dumping was showed in the course of the investigation. On the basis of the findings of the investigation, the Commission has adopted the implementing regulation to the effect that a definitive anti-dumping duty at the level of the dumping margin found (i.e. 54.1% of the net, free-at-Union-frontier price before duty) would be imposed on imports of the concerned product produced by the applicant, and that the anti-dumping duty would be levied retroactively on imports which have been made subject to the above-mentioned registration.

4.The implementing regulation imposing the anti-dumping duty for the applicant enters into force on 6 September 2014.

BACKGROUND

5.Definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China was initially imposed with effect from 22 July 2005 for five years. Consequent to a circumvention investigation, the anti-dumping duty has been extended from 17 June 2009 to imports of hand pallet trucks and their essential parts consigned from Thailand, whether declared as originating in Thailand or not. As a result of an expiry review, the definitive anti-dumping duty has been maintained with effect from 14 October 2011 for another five years.

6.Following a partial interim review and the above "new exporter" review, the application rate of anti-dumping duty has become 70.8% of the net, free-at-Union-frontier price before duty, except for two companies (including the applicant in the above "new exporter" review) whose individual duty rates range from 54.1% to 70.8%.
