European Union (EU) * : Amendment to the Implementing Regulation Imposing a Definitive Anti-dumping Duty and Collecting Definitively the Provisional Duty on Imports of Ceramic Tableware and Kitchenware Originating in the Mainland of China

Further to Commercial Information Circular No. 378/2013 of 15 May 2013, the European Commission (the Commission) has published amendment to the implementing regulation imposing a definitive anti-dumping duty on imports of ceramic tableware and kitchenware originating in the Mainland of China. DETAILS

2.The Council of the EU promulgated Implementing Regulation (EU) No 412/2013 (the original implementing regulation) in May 2013 to impose a definitive anti-dumping duty on imports of ceramic tableware and kitchenware originating in the Mainland of China. Article 3 of the original implementing regulation provided that where any new exporting producer of tableware in the Mainland of China could provide sufficient evidence to the Commission that it met the three criteria set out therein, the original implementing regulation could be amended by granting the new exporting producer the duty rate applicable to the cooperating companies not included in the sample during the original investigation, namely the weighted average duty rate of 17.9%.

3.Four companies who were manufacturers and exporters of the concerned products came forward after the publication of original implementing regulation claiming that they met the three criteria and provided evidence. The Commission analysed the evidence and found that each of the four companies met the three criteria to be considered as new exporting producers. Having informed the four companies and the Union industry of the findings and receiving no comments, the original implementing regulation is amended by adding the four companies to the list of exporting producers from the Mainland of China to which the weighted average duty rate of 17.9% applies.

4.The amending implementing regulation shall enter into force on 26 July 2014.

BACKGROUND

5.Definitive anti-dumping duty on imports of ceramic tableware and kitchenware originating in the Mainland of China has been imposed since 16 May 2013. The current rate of duty is 36.1% of the net, free-at-Union-frontier price before duty (except for a number of companies whose individual duty rates range from 13.1% to 23.4%).
