European Union (EU)* : Results of "New Exporter" Review of the Anti-dumping Measures on Imports of Trichloroisocyanuric Acid Originating in the Mainland of China

Further to the Commercial Information Circular No. 698/2013 of 28 August 2013, the European Commission (the Commission) has promulgated an implementing regulation to impose a definitive anti-dumping duty on imports of trichloroisocyanuric acid originating in the Mainland of China and manufactured by a Chinese exporting producer. DETAILS

2.On 28 August 2013, the Commission initiated a "new exporter" review at the request of Chinese exporting producer, Liaocheng City Zhonglian Industry Co. Ltd. (the applicant), which claimed that it did not export trichloroisocyanuric acid to the Union during the original period of investigation on which the anti-dumping measures in force were based (i.e. 1 April 2003 to 31 March 2004), that it was not related to any of the exporting producers subject to the concerned anti-dumping measures, and that it had begun exporting the concerned product to the Union only after the end of the original investigation period. Having examined the submitted evidence, the Commission considered it sufficient to justify the initiation of the review. The anti-dumping duty in force was repealed with regard to imports of the concerned product produced and sold for export to the Union by the applicant. Simultaneously, customs authorities of the Union were directed to take appropriate steps to register such imports.

3.Existence of dumping was showed in the course of the investigation. On the basis of the findings of the investigation, the Commission has concluded that a definitive anti-dumping duty should be imposed for the applicant at the level of the dumping margin found, i.e. 32.8% and the anti-dumping duty applicable to the applicant shall be levied retroactively on imports of the concerned product which have been made subject to registration. The implementing regulation imposing the anti-dumping duty for the applicant enters into force on 28 May 2014.

BACKGROUND

4.Definitive anti-dumping duty on trichloroisocyanuric acid originating in the Mainland of China has been imposed since 8 October 2005. As a result of an expiry review initiated on 6 October 2010, the definitive anti-dumping duty has been maintained for five years with effect from 31 December 2011. Following the "new exporter" review, the duty in force has become 42.6% of the net, free-at-Union-frontier price before duty (except for five companies whose individual duty rates range from 3.2% to 40.5%).
