European Union (EU) * : Results of an Interim Review of the Anti-dumping Duty on Imports of Bicycles Originating in the Mainland of China

Further to Commercial Information Circular No. 194/2012 of 9 March 2012, the Council of the EU has published a regulation to amend the implementing regulation of 2011 imposing a definitive anti-dumping duty on imports of bicycles originating in the Mainland of China following an interim review. DETAILS

2.After the conclusion of an expiry review in October 2011 on imports of bicycles originating in the Mainland of China, the European Commission (the Commission) had at its disposal evidence indicating that, as far as dumping and injury are concerned, the circumstances on the basis of which the existing anti-dumping measures on imports of bicycles originating in the Mainland of China were imposed might have changed and that these changes might be of a lasting nature. In March 2012, the Commission initiated, on an ex-officio basis, an interim review of the anti-dumping measures applicable to imports of bicycles originating in the Mainland of China following a determination that sufficient prima facie evidence existed for the initiation of investigation.

3.Consequent to the interim review, Implementing Regulation (EU) No 990/2011 imposing a definitive anti-dumping duty on imports of bicycles originating in the Mainland of China is amended to the effect that the applicable rate of definitive anti-dumping duty on imports of bicycles and other cycles (including delivery tricycles, but excluding unicycles), not motorised, falling within CN codes 8712 00 30 and ex 8712 00 70 (TARIC codes 8712 00 70 91 and 8712 00 70 99) would become 48.5% of the net, free-at-Union-frontier price before duty (except for three companies whose individual duty rates range from 0% to 19.2%).

4.The amending regulation, which will enter into force on 6 June 2013, also maintains the extension by Regulation (EC) No 71/97 the antidumping duty imposed on imports of bicycles originating in the Mainland of China to imports of certain bicycle parts originating in the Mainland of China.

BACKGROUND

5.Definitive anti-dumping duty on imports of bicycles originating in the Mainland of China has been imposed since 10 September 1993. Based on the findings of a circumvention investigation, the definitive anti-dumping duty has been extended to imports of certain bicycle parts originating in the Mainland of China from 19 January 1997. The duty was also extended, for five years on each occasion, in July 2000, July 2005 and October 2011 as a result of the expiry or interim reviews conducted. Consequent to a recent circumvention investigation, the anti-dumping duty has been extended to imports of bicycles consigned from Indonesia, Malaysia, Sri Lanka and Tunisia, whether declared as originating in Indonesia, Malaysia, Sri Lanka and Tunisia or not, with effect from 6 June 2013.
