Commercial Information Circular No. 396/2013

European Union (EU)* : Termination of the Countervailing Proceeding on Imports of Bicycles Originating in the Mainland of China

Further to Commercial Information Circular 931/2012 of 14 November 2012, the European Commission (the Commission) has published a decision to terminate the countervailing proceeding concerning imports of bicycles originating in the Mainland of China.  The decision can be accessed through the following link:

DETAILS

2. The Commission announced by a notice published on 27 April 2012 the initiation of a countervailing proceeding with regard to imports of bicycles originating in the Mainland of China following a complaint lodged on 15 March 2012 by EBMA, the European Bicycles Manufacturers Association (the complainant), on behalf of Union producers representing more than 25% of the total Union production of bicycles.

3. By a letter of 22 March 2013 addressed to the Commission, however, the complainant formally withdrew its complaint.  The Commission considered that the present proceeding should be terminated since the respective countervailing investigation had not brought to light any considerations showing that such termination would not be in the Union interest.  Interested parties were informed and given an opportunity to comment but no comments were received that would give a reason to reach a different conclusion.  The Commission has therefore adopted the decision to terminate the countervailing proceeding concerning imports of bicycles and other cycles (including delivery tricycles but excluding unicycles), not motorised, originating in the Mainland of China and currently falling within CN codes 8712 00 30 and ex 8712 00 70.

4. The decision will enter into force on 24 May 2013.

5.  Currently, the Commission has initiated an interim review of the anti-dumping measures imposed on imports of bicycles originating in the Mainland of China as well as an investigation concerning the possible circumvention of the anti-dumping measures imposed on bicycles originating in the Mainland of China by imports of bicycles consigned from Indonesia, Malaysia, Sri Lanka and Tunisia, whether declared as originating in Indonesia, Malaysia, Sri Lanka and Tunisia or not.  For details, please refer to the Commercial Information Circulars Nos. 194/2012 of 9 March 2012 and 770/2012 of 26 September 2012.
