European Union (EU)* : Amendment to the Notice on Initiation of Countervailing Proceeding Concerning Imports of Bicycles Originating in the Mainland of China, and Extending the Proceeding to Imports of Such Bicycles Consigned from Indonesia, Malaysia, Sri Lanka and Tunisia

Further to Commercial Information Circulars Nos. 308/2012 of 27 April 2012, 313/2012 of 2 May 2012 and 770/2012 of 26 September 2012, the European Commission (the Commission) has published a notice to amend an earlier notice on initiation of a countervailing proceeding concerning imports of bicycles originating in the Mainland of China, and extending the proceeding to imports of such bicycles consigned from Indonesia, Malaysia, Sri Lanka and Tunisia. 2.The Commission initiated a countervailing proceeding concerning the imports of bicycles originating in the Mainland of China on 27 April 2012. Separately, on 26 September 2012, it published a regulation initiating an investigation concerning the possible circumvention of anti-dumping measures imposed on imports of bicycles originating in the Mainland of China by imports of bicycles consigned from Indonesia, Malaysia, Sri-Lanka and Tunisia, whether declared as originating in Indonesia, Malaysia, Sri-Lanka and Tunisia or not, and making such imports subject to registration.

3.As the anti-dumping anti-circumvention investigation covers the same product as the countervailing investigation, it is considered that the scope of the notice initiating the countervailing proceeding should be amended ex officio to reflect the initiation of the anti-dumping anti-circumvention investigation. This is said to be necessary, inter alia, in order to enable, if appropriate, the inclusion of any imports of the product concerned originating in the Mainland of China, consigned from Indonesia, Malaysia, Sri Lanka and Tunisia, in the causation analysis of the countervailing proceeding.

4.All interested parties wishing to submit the relevant information specified in the amending notice must do so within 37 days from 14 November 2012, unless otherwise specified.

FURTHER INFORMATION

5.Definitive anti-dumping duty on imports of bicycles originating in the Mainland of China has been imposed since 10 September 1993. Based on the findings of a circumvention investigation, the definitive anti-dumping duty has been extended to imports of certain bicycle parts originating in the Mainland of China on 19 January 1997. On the basis of an interim review, the anti-dumping duty has been increased to 48.5% of the net, free-at-Union-frontier price before duty since 15 July 2005. Following an expiry review, the duty has been extended for another five years with effect from 7 October 2011. 

6.Currently, the Commission has also initiated an interim review of the anti-dumping measures on imports of bicycles originating in the Mainland of China. For details, please refer to the Commercial Information Circular No. 194/2012 of 9 March 2012.
