European Union (EU)* : Amendment to the Regulation Imposing a Definitive Anti-dumping Duty on Imports of Certain Iron or Steel Fasteners Originating in the Mainland of China

Further to Commercial Information Circulars Nos. 177/2012 of 7 March 2012 and 431/2012 of 7 June 2012, the Council of the EU has published an implementing regulation to amend the regulation of 2009 imposing a definitive anti-dumping duty on imports of certain iron or steel fasteners originating in the Mainland of China (the definitive Regulation). DETAILS

2.On 28 July 2011, the Dispute Settlement Body (DSB) of the World Trade Organization adopted the Appellate Body Report and the Panel Report as modified by the Appellate Body Report in the dispute 'European Communities - Definitive Anti-Dumping Measures on Certain Iron or Steel Fasteners from China' (the DSB reports). On 6 March 2012, the European Commission (the Commission) published a notice to, inter alia, initiate a review to reassess the definitive findings of the original investigation by taking account of the recommendations and rulings of the DSB. In addition, the Commission published a notice on 6 June 2012 announcing the review of the current situation for one exporting producer, Bulten Fasteners (China) Co., Ltd.

3.On the basis of the reassessment, it is concluded that the injurious dumping determined in the original investigation is confirmed. However, Bulten Fasteners (China) Co., Ltd. should be granted individual treatment in accordance with the recommendations in the DSB reports. Besides, the definitive Regulation should also be amended to take account of the revised anti-dumping duties calculated for some of the companies listed in the definitive Regulation.

4.Following the entry into force of the implementing regulation, the rates of definitive anti-dumping duty applicable to imports of certain iron or steel fasteners originating in the Mainland of China would become 74.1% of the net, free-at-Union-frontier price before duty (except for a number of companies whose individual duty rates range from 0% to 69.7%).

5.The implementing regulation shall enter into force on 11 October 2012.

BACKGROUND

6.Definitive anti-dumping duty on certain iron or steel fasteners originating in the Mainland of China has been imposed since 1 February 2009. Consequent to a circumvention investigation, the definitive anti-dumping duty has been extended with effect from 27 July 2011 to imports of the same products consigned from Malaysia, regardless of whether they are declared as originating in Malaysia or not.
