European Union (EU)* : Termination of the Partial Interim Review and the Expiry Review of the Anti-dumping Measures on Imports of Certain Plastic Sacks and Bags Originating in, inter alia, the Mainland of China

Further to the Commercial Information Circular No. 582/2011 of 27 September 2011, the Council of the EU (the Council) has published a regulation to terminate the partial interim review and the expiry review of the anti-dumping measures applicable on imports of certain plastic sacks and bags originating in, inter alia, the Mainland of China as well as to repeal the anti-dumping measures. DETAILS

2.On 21 September 2010, the European Commission (the Commission) announced the initiation of a partial interim review of the anti-dumping measures imposed on imports of certain plastic sacks and bags originating in, inter alia, the Mainland of China, following a request lodged by one Chinese company. On 27 September 2011, the Commission announced the initiation of an expiry review of the anti-dumping measures, following a request lodged by 44 Union producers representing around 30% of the totals estimated Union production of certain plastic sacks and bags.


3.During the investigations, the low level of cooperation of the Union producers and the lack of a representative sample prevented the Commission from being able to make assessment. It can thus not be concluded whether the expiry of the anti-dumping measures in place would be likely to lead to a continuation or recurrence of injury and that the investigation should be terminated on these grounds. It follows that the interim review is without purpose and should be terminated as well. 


4.Having considered the comments and responses from relevant parties, the Council has adopted the regulation to repeal the anti-dumping measures on imports of certain plastic sacks and bags originating in, inter alia, the Mainland of China and terminate the proceeding concerning these imports. The regulation also terminates the partial interim review of the anti-dumping measures applicable to imports of certain plastic sacks and bags originating in the Mainland of China.


5.The regulation shall enter into force on 14 July 2012.

BACKGROUND

6.Definitive anti-dumping duties on certain plastic sacks and bags originating in, inter alia, the Mainland of China have been imposed since 30 September 2006. The rate of duty is 28.8% of the net, free-at-Union-frontier price before duty (except for a number of companies where the individual duty rates range from 4.3% to 12.8%).
