European Union (EU)* : Amendment to the Implementing Regulation Imposing
a Definitive Anti-dumping Duty on Imports of Tartaric Acid Originating
in the Mainland of China

Further to Commercial Information Circular No. 411/2012 of 5 June 2012, the Council of the EU (the Council) has published a regulation to amend the Implementing Regulation imposing a definitive anti-dumping duty on imports of tartaric acid originating in the Mainland of China to adjust the individual duty rates for two Chinese companies. DETAILS

2. On 29 July 2011, the European Commission announced the initiation of an interim review on the anti-dumping measures imposed on imports of tartaric acid originating in the Mainland of China following a review request which was lodged by a number of producers in the Union and limited in scope to the examination of dumping as far as two Chinese companies, namely, Changmao Biochemical Engineering Co. Ltd, Changzhou, and Ninghai Organic Chemical Factory, Ninghai, are concerned.

In light of the findings of investigation, it is considered that the level of the existing anti-dumping duty measures in force on imports of tartaric acid from the Mainland of China should be amended. Having considered the representations and responses from relevant parties, the Council has adopted the amending regulation to adjust the individual duty rates for the two companies to 13.1% and 8.3% respectively.

4. The amending regulation shall enter into force on 14 July 2012.

BACKGROUND

5. Definitive anti-dumping duty on imports of tartaric acid originating in the Mainland of China has been imposed since 28 January 2006. As a result of an amending regulation adopted on 13 April 2012, one Chinese company is excluded from the definitive anti-dumping measures imposed. As a result of an expiry review, the definitive anti-dumping duty is maintained for five years with effect from 25 April 2012. Following the adoption of the present amending regulation, the rate of duty will be 34.9% of the net, free-at-Union-frontier price before duty (except for the above two companies, whose individual duty rates will be 13.1% and 8.3% respectively).
