European Union (EU)* : Amendment to the Implementing Regulation Imposing a Definitive Anti-dumping Duty and Collecting Definitively the Provisional Duty Imposed on Imports of Ceramic Tiles Originating in the Mainland of China

Further to Commercial Information Circular No. 553/2011 of 15 September 2011, the Council of the EU ('the Council') has published a regulation to amend the Implementing Regulation imposing a definitive anti-dumping duty and collecting definitively the provisional duty imposed on imports of ceramic tiles originating in the Mainland of China ('Implementing Regulation') by adding one Chinese company to a list of producers attributed a 30.6 % duty rate. DETAILS

2. The Implementing Regulation stipulates that where any new exporting producer in the Mainland of China provides sufficient evidence that it meets the criteria set out therein, the Implementing Regulation can be amended by granting to such new exporting producer the duty rate applicable to the cooperating companies not included in the sample of the original investigation that led to the imposition of the anti-dumping duty, i.e. 30.6%.

3. On receipt from one Chinese company an application for such 'new exporting producer treatment', an examination was carried out and the evidence provided by the company was considered sufficient to show that it fulfils the concerned criteria. Having informed the company and the Union industry and given them the opportunity to submit comments, and having analysed and duly taken into account all arguments and submissions made by interested parties, the Council has adopted the amending regulation for the concerned company to be added to the list of cooperating producers attributed a 30.6 % duty rate in the Implementing Regulation.

4.The amending regulation shall enter into force on 30 June 2012.

BACKGROUND

5. Definitive anti-dumping duty on imports of ceramic tiles originating in the Mainland of China has been imposed since 16 September 2011. The current duty in force is 69.7% of the net, free-at-Union-frontier price before duty (except for a number of companies whose individual duty rates range from 26.3% to 36.5%).
