Dear Sirs,

Commercial Information Circular No. 264/2012

European Union (EU)* : Termination of the Anti-dumping Proceeding on Imports of Sodium Cyclamate Originating in the Mainland of China, Limited to Two Chinese Exporting Producers

Further to the Commercial Information Circular No. 114/2011 of 17 February 2011, the European Commission (the Commission) has published a decision to terminate the anti-dumping proceeding concerning imports of sodium cyclamate originating in the Mainland of China, limited to two Chinese exporting producers, Fang Da Food Additive (Shen Zhen) Limited and Fang Da Food Additive (Yang Quan) Limited ('the Fang Da group'). The decision can be accessed through the following link :
http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2012:099:0033:0034:EN:PDF

DETAILS

2. The Commission initiated the anti-dumping proceeding on 17 February 2011 on the basis of a complaint lodged by Productos Aditivos SA ('the complainant') which alleged that imports of the concerned product originating in the Mainland of China and produced by the Fang Da group were being dumped, thereby causing material injury to the Union industry.

3.By a letter of 17 January 2012 to the Commission, the complainant withdrew its complaint. The Commission considered that the present proceeding should be terminated since the investigation had not brought to light any consideration showing that such termination would not be in the Union interest. The Commission therefore concludes that the anti-dumping proceeding concerning imports of sodium cyclamate originating in the Mainland of China, limited to the Fang Da group, should be terminated. The corresponding review based on article 2(3) of council regulation (EC) No 1515/2001 can therefore also be terminated

BACKGROUND

4. Definitive anti-dumping duty on sodium cyclamate originating in, inter alia, the Mainland of China was first imposed with effect from 12 March 2004 for five years with duty rate of EUR 0.26 per kilogramme (except for three companies with individual duty rates ranging from EUR 0 to EUR 0.11 per kilogramme).

5. At the request of the same complainant, the Commission initiated an expiry review on 10 March 2009. As a result of the review, the definitive anti-dumping duty on sodium cyclamate originating in, inter alia, the Mainland of China has been maintained with effect from 9 June 2010 for another five years.
