Dear Sirs,

Commercial Information Circular No. 827/2011

European Union (EU)* : Directive on Indications or Marks Identifying the Lot to which a Foodstuff Belongs

The European Parliament and the Council of the EU have recently adopted a Directive concerning the indications or marks identifying the lot to which a foodstuff belongs. Details are set out in Commission Directive 2011/91/EU (the Directive), which can be accessed through the following link : http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2011:334:0001:0005:EN:PDF

DETAILS

2. The indications or marks identifying the lot to which a foodstuff belongs were previously governed by 89/396/EEC but it has been substantially amended several times. For interests of clarity and rationality, Directive 89/396/EEC should be codified.

3. The Directive 2011/91/EU aims to provide rules of a general nature in order to manage a common lot identification system. It concerns the indication which allows identification of the lot (a batch of sales units of a foodstuff produced, manufactured or packaged under practically the same condition) to which a foodstuff belongs. A foodstuff may not be marketed unless it is accompanied by such an indication but exemptions applied to products as mentioned in Article 2 (2) of the Directive. For details of the identification methods, you may refer to Articles 3-7. The Directive shall enter into force on 5 January 2012.
