European Union (EU)* : Results of New Exporting Producers' Requests under the Anti-dumping Measures on Imports of High Tenacity Yarn of Polyesters Originating in the Mainland of China

Further to Commercial Information Circular No. 558/2010 of 2 December 2010, the Council of the EU has published a regulation announcing the decision to grant "New Exporting Producer Treatment" (NEPT) to a Mainland company named Jiangsu Hengli Chemical Fibre Co. Ltd under the anti-dumping measures on imports of high tenacity yarn of polyesters originating in the Mainland of China. 2. Salient points of the treatment for the aforesaid company are set out below -

BACKGROUND

3. In accordance with Council Implementing Regulation (EU) No 1105/2010 of 29 November 2010, definitive anti-dumping duty on imports of high tenacity yarn of polyesters originating in the Mainland of China has been imposed for 5 years since 2 December 2010. The duty rate is set at 9.8% of the net, free-at-Union-frontier price before duty (except for eleven companies with individual duty rates ranging from 0% to 9.8%).

4. Two companies (the applicants) requested to be granted NEPT under Article 4 of Implementing Regulation (EU) No 1105/2010. The verification by the Commission showed that Jiangsu Hengli Chemical Fibre Co. Ltd had provided sufficient evidence to prove that it meets the criteria for being granted NEPT. It could therefore be granted the weighted average duty rate for the cooperating companies not included in the sample (i.e. 5.3%) and added to the list of exporting producers of Article 1(2) of the Regulation. It was also concluded that the other applicant, Amann Twisting Yancheng Co. Ltd, did not fulfil the requirement for NEPT.
