Commercial Information Circular No. 296/2011

European Union (EU)*: Amendment to Directive on Cosmetic Products

Further to Commercial Information Circular No. 303/2010 dated 2 July 2010, the European Commission (the Commission) has adopted a Directive to amend Annexes II and III of Council Directive 76/768/EEC relating to cosmetic products for the purpose of adaption to technical progress. DETAILS

2. In the light of the risk assessment of the submitted safety data and the final opinions given by the Scientific Committee on Consumer Safety (SCCS) on the safety of individual substances and of the reaction products, Annex III of Directive 76/768/EEC has to be amended to include provisionally authorised hair dye substances. As for the substances hydroxyethyl-2-nitro-p-toluidine and HC Red No 10 + HC Red No 11, the safety assessment by the SCCS could not be finalised before 31 December 2010. Therefore, the provisional use of the substances should be prolonged until 31 December 2011. The SCCS opined that no final decision on the safety of the substance o-aminophenol could be drawn based on the available data and thus it could not be considered safe when used in hair dye products and should be listed in Annex II of Directive 76/768/EEC.
