European Union (EU)*: Granting "New Exporting Producer Treatment" to an Exporting Producer for the Anti-dumping Measures on Imports of Certain Plastic Sacks and Bags Originating in, inter alia, the Mainland of China

Further to the Commercial Information Circular No. 133/2009 of 12 March 2009, the Council of the EU has published a regulation to grant "New Exporting Producer Treatment (NEPT)" for the definitive anti-dumping duty on imports of certain plastic sacks and bags originating in, inter alia, the Mainland of China to an exporting producer consequent to the NEPT examination. DETAILS

2. Six Chinese companies have applied to be granted NEPT. An examination has been carried out to determine whether they fulfil the criteria for being granted NEPT. The evidence provided by one of the Chinese exporting producers, namely Xiamen Good Plastic Co., Ltd was considered sufficient to show that it fulfils the criteria. This exporting producer is therefore granted the duty rate of 8.4% applicable to the cooperating companies not included in the sample of exporting producers in the original investigation with effect from 19 May 2011.

BACKGROUND

3. Definitive anti-dumping duties on certain plastic sacks and bags originating in, inter alia, the Mainland of China have been imposed since 30 September 2006. The current duty in force is 28.8% of the net, free-at-Union-frontier price before duty (except for a number of companies where the individual duty rates range from 4.3% to 12.8%) (details can be found in Commercial Information Circulars No. 388/2006 of 29 September 2006, No. 180/2008 of 20 March 2008, and No. 133/2009 of 12 March 2009).
