European Union (EU)* : Results of an Investigation Concerning the Possible Circumvention of Anti-dumping Measures Imposed on Imports of Certain Plastic Sacks and Bags Originating in the Mainland of China by Imports of Such Products Channelled via a Chinese Company Subject to a Lower Duty Rate

Further to the Commercial Information Circular No. 375/2010 of 20 August 2010, the Council of the EU has published a regulation to (i) extend the definitive anti-dumping duty of 28.8% applicable to 'all other companies' imposed on imports of certain plastic sacks and bags originating in the Mainland of China to imports declared as having been manufactured by Xiamen Xingxia Polymers Co., Ltd. ('Xiamen'), and (ii) discontinue the registration of the product concerned declared as being manufactured by Xiamen. DETAILS

2. The European Commission published in August 2010 a regulation to initiate an investigation concerning the possible circumvention of anti-dumping measures imposed on certain plastic sacks and bags originating in the Mainland of China by imports of such products channelled via Xiamen subject to a lower duty rate. The regulation also requires imports of the product concerned declared as being manufactured by Xiamen to be subject to registration.

3. Based on the findings of the circumvention investigation, the Council has decided that with effect from 19 May 2011, the definitive anti-dumping duty of 28.8% applicable to 'all other companies' imposed on imports of certain plastic sacks and bags originating in the Mainland of China is extended to imports declared as having been manufactured by Xiamen.

4. With the extension of the anti-dumping duty, the registration requirement of imports of the product concerned declared as being manufactured by Xiamen is discontinued.

BACKGROUND

5. Definitive anti-dumping duties on certain plastic sacks and bags originating in, inter alia, the Mainland of China have been imposed since 30 September 2006. The current duty in force is 28.8% of the net, free-at-Union-frontier price before duty (except for a number of companies where the individual duty rates range from 4.3% to 12.8%) (details can be found in Commercial Information Circulars No. 388/2006 of 29 September 2006, No. 180/2008 of 20 March 2008, and No. 133/2009 of 12 March 2009).
