European Union (EU)* : Initiation of a Partial Reopening of the Anti-dumping Investigation on Imports of Certain Compressors Originating in the Mainland of China
Further to the Commercial Information Circulars No. 126/2010 of 23 March 2010, the European Commission (the Commission) has published a notice to initiate a partial reopening of the anti-dumping investigation on imports of certain compressors originating in the Mainland of China. The Commission has decided on its own initiative to partially reopen the anti-dumping investigation on the products concerned on 30 March 2011. The reopening is limited to the examination of whether certain product types fall within the scope of the anti-dumping measures imposed on imports of certain compressors.
3. The information at the Commission's disposal indicates that so-called mini-compressors appear to be distinct from the other compressors subject to the measures concerned. Therefore, it is considered appropriate to partially reopen the investigation for the clarification of the scope of the product, as the conclusion of which may possibly have retroactive effect as of the date of the imposition of the measures concerned.
Review Procedures
4. Salient points of the partial reopening of anti-dumping investigation are set out below-

(b) Product Coverage | : | Reciprocating compressors (excluding reciprocating compressor pumps), giving a flow not exceeding 2 cubic meters (m3) per minute, currently falling within CN codes ex 8414 40 10, ex 8414 80 22, ex 8414 80 28 and ex 8414 80 51. |

In order to obtain information for the investigation, the Commission will examine the information submitted by all interested parties. All interested parties must make themselves known, submit information and provide supporting evidence within 40 days from 30 March 2011, unless otherwise specified. They may also apply to be heard within 40 days from 30 March 2011. BACKGROUND
5. Definitive anti-dumping duty on imports of certain compressors originating in the Mainland of China has been imposed since 21 March 2008 at a rate of 77.6% of the net, free-at-Union-frontier price before duty (except for 14 companies whose individual duty rates range from 10.6% to 77.6%). The anti-dumping measures expired on 21 March 2010.
