Dear Sirs,

Commercial Information Circular No. 557/2010

European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Certain Castings Originating in the Mainland of China

Further to the Commercial Information Circulars Nos. 289/2005 of 2 August 2005 and 307/2009 of 16 June 2009, the European Commission (the Commission) has published a notice to initiate a partial interim review of the anti-dumping measures imposed on imports of certain castings originating in the Mainland of China. The notice can be accessed through the following link : http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:C:2010:324:0021:0023:EN:PDF

DETAILS

  1. The review was initiated at the request of Shandong Lulong Group Co. Ltd. ('the applicant'), and is limited in scope to the examination of dumping as far as the applicant is concerned.

  2. The applicant has provided prima facie evidence that the circumstances on the basis of which measures were imposed have changed and that these changes are of a lasting nature. In particular, the applicant has provided prima facie evidence showing that it qualifies for market economy treatment and the imposition of the measure at its current level is not necessary to offset dumping. A comparison of the applicant's domestic prices and its export prices to the Union indicates that the dumping margin appears to be substantially lower than the current level of the measure.

Review Procedures

  1. Salient points of the partial interim review are set out below-

BACKGROUND

  1. Definitive anti-dumping duty on imports of certain castings originating in the Mainland of China has been imposed since 30 July 2005 at a rate of 47.8% of the net, free-at-Union-frontier price before duty (except for a number of companies with individual duty ranging from 0% to 37.9%).

  2. An expiry review on the definitive anti-dumping duty has been initiated at the request of Eurofonte (please refer to the Commercial Information Circular No. 340/2010 of 27 July 2010 for details).
