Commercial Information Circular No. 335/2010

European Union (EU)* : Labelling and Standard Product Information of Energy-related Products

Further to Commercial Information Circular No. 560/2009 dated 6 November 2009, the European Parliament and the Council of the European Union has adopted a Directive concerning the energy labelling and standard product information of energy-related products. DETAILS

  2. The Directive establishes a framework for harmonising national measures on user information, in particular energy labelling and standard product information of energy-using products, which allows users to choose more efficient products. It shall be applied to energy-related products which have a significant direct or indirect impact on energy consumption and other essential resources during use. However, the Directive is not applicable to the following: 

- second-hand products;
- any means of transport for persons or goods; and
- the rating plate or its equivalent affixed for safety purposes to products;
  1. Under the Directive, the European Commission (the Commission) shall adopt delegated acts laying down detail requirements for the label and the fiche (a standard table of information of a product) for each type of product. Product suppliers are required to ensure that they supply the label and the fiche accordingly. In the case of internet selling, telemarketing or similar forms of selling, hire or hire-purchase where the user cannot directly see the product, suppliers shall ensure that their potential customers are provided with the information specified for the label and the fiche under the delegated acts before purchase. In addition, suppliers are required to produce technical documentation sufficient to ensure the accuracy of information contained in the label and the fiche. The technical documentation shall be made available for inspection for a period of 5 years after the manufacture of the last product. The documentation includes: 

  1. a general description of the product; 
     

  2. the results of design calculations carried out, where relevant;
     

  3. test reports, including those carried out by relevant notified organisations defined under other Union legislation, where available; and
     

  4. where values are used for similar models, the reference allowing identification of those models.

Upon request, suppliers are required to produce an electronic version of the technical documentation to the market surveillance authorities and to the Commission within 10 working days.

  1. Council Directive 92/75/EEC of 22 September 1992 with regard to energy labelling and standard product information of household appliances shall be repealed with effect from 21 July 2011.
