30 June 2010

Dear Sirs,

Commercial Information Circular No. 302/2010

European Union (EU)* : Safety Data Sheets under REACH

Further to Commercial Information Circulars No. 174/2010 of 23 April 2010 and No. 478/2009 of 24 September 2009, the European Commission (the Commission) has adopted a Regulation revising the requirements for the compilation of safety data sheets under REACH. Details are set out in the Commission Regulation (EU) 453/2010 (the Regulation), which can be accessed through the following link :http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2010:133:0001:0043:EN:PDF

DETAILS

  1. Safety data sheets have been widely use as a method for providing information on substances and mixtures under REACH. Nevertheless, the Commission is in the process of harmonising the classification, packaging, and labelling of dangerous substances, as stipulated under Regulation (EC) No. 1272/2008, and there is a transitional period before the completion of the harmonisation on 1 June 2015. Hence, the requirements for compiling the safety data sheets under REACH have to be revised, taking into account of the timeframe specified in Regulation (EC) No. 1272/2008.

  1. Under the Regulation, with effect from 1 December 2010, Annex I of the Regulation on the safety data sheet requirements of REACH will be used. When the harmonisation process of dangerous substances under Regulation (EC) No. 1272/2008 is completed on 1 June 2015, the safety data sheet requirements in Annex II of the Regulation will then be used.
