Commercial Information Circular No. 220/2010

European Union (EU)*: Authorisation of certain Health Claims made on Food

Further to Commercial Information Circular No. 617/2009 of 11 December 2009, the European Commission (the Commission) has adopted two Regulations revising the conditions of use of certain health claims authorised and introducing a new authorisation of health claim made on food. Details are set out in Commission Regulations (EU) Nos. 376/2010 and 384/2010 (the Regulations) respectively. The Regulations can be accessed through the following links:

DETAILS

  1. According to Regulation (EC) No. 1924/2006, health claims made on food are prohibited unless they are authorised by the Commission. Following two scientific opinions of the European Food Safety Authority on plant stanols and plant sterols, and upon receipt of applications for authorisation of health claims submitted by various food business operators, the Commission has concluded the amendment and authorisation of certain health claims made on food based on the scientific data presented. Details of the revised, permitted and rejected health claims can be found in the Regulations.

  1. Separately, the Commission has adopted three Regulations rejecting several applications for authorisation of health claims submitted by other food business operators. Details are set out in Commission Regulations (EU) Nos. 375/2010, 382/2010 and 383/2010, which can be accessed through the following links respectively:
