European Union (EU)* : Extension of the Definitive Anti-dumping Duty Imposed on Imports of Steel Ropes and Cables Originating in the Mainland of China to Imports of the Same Product Consigned from the Republic of Korea, whether Declared as Originating in the Republic of Korea or not, and Termination of the Investigation of the Possible Circumvention of the Anti-dumping Measures on the Same Products in respect of Imports Consigned from Malaysia

Further to the Commercial Information Circular No. 416/2009 of 12 August 2009, the Council of the EU (the Council) has published a regulation to extend the anti-dumping duty imposed on imports of steel ropes and cables originating in the Mainland of China to imports of the same product consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not, and terminating the investigation concerning the possible circumvention of the anti-dumping measures in respect of imports consigned from Malaysia. DETAILS

  1. The European Commission (the Commission) published a regulation on 12 August 2009 to initiate an investigation into the alleged circumvention of anti-dumping measures imposed on imports of steel ropes and cables originating in the Mainland of China by imports of the same product consigned from the Republic of Korea and Malaysia.

  1. Based on the findings of the circumvention investigation, the Council has decided that with effect from 12 May 2010, the definitive anti-dumping duty imposed on imports of steel ropes and cables, originating in the Mainland of China, falling within CN codes ex 7312 10 81, ex 7312 10 83, ex 7312 10 85, ex 7312 10 89 and ex 7312 10 98 (TARIC codes 7312 10 81 13, 7312 10 83 13, 7312 10 85 13, 7312 10 89 13 and 7312 10 98 13), is extended to imports of the same product consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not.

  1. The Commission may authorise by decision the exemption of imports which do not circumvent the anti-dumping measures from the anti-dumping duty extended by this regulation. Requests for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant.   1. With the extension of the anti-dumping duty, the registration requirement of imports of the product concerned consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not, is discontinued.

  1. Meanwhile, in view of the findings regarding Malaysia, the investigation concerning the possible circumvention of anti-dumping measures by imports of the same products consigned from Malaysia is terminated and the registration of imports of the same products consigned from Malaysia is discontinued.

BACKGROUND

  1. Definitive anti-dumping duty on imports of steel ropes and cables originating in, inter alia, the mainland of China had been imposed since 18 August 1999. The rate of duty was 60.4% of the net, free-at-Union-frontier price before duty.

  1. An expiry review was initiated on 17 August 2004. Based on the results of the review investigation, the anti-dumping duty was maintained for another five years with effect from 17 November 2005.

  1. Based on the findings of a circumvention investigation, the Council further extended, with effect from 31 October 2004, the definitive anti-dumping duty imposed on imports of steel ropes and cables originating in the mainland of China to imports of the same products consigned from Morocco, whether declared as originating in Morocco or not (TARIC codes 7312 10 82 12, 7312 10 84 12, 7312 10 86 12, 7312 10 88 12 and 7312 10 99 12 respectively) (for details, please refer to Commercial Information Circular No. 280/2004).
