Commercial Information Circular No. 104/2010

European Union (EU)*: Amendments to Regulation Setting Maximum Levels for Certain Contaminants in Foodstuffs

Further to our Commercial Information Circular No. 348/2008 of 8 July 2008, the European Commission (the Commission) has recently adopted two Regulations amending Regulation (EC) No. 1881/2006 concerning the maximum levels for certain contaminants in foodstuffs. Details are set out in the Commission Regulation (EU) No. 105/2010 and No. 165/2010 (the Regulations). The Regulations can be accessed through the following links respectively:

DETAILS

  1. In order to protect public health and taking into account of new scientific information, the EU authorities considered necessary to revise the maximum levels of ochratoxin A and aflatoxin in certain foodstuff. Details of the amendments are set out in the Regulations.

  1. Regulation No 165/2010 shall enter into force on 8 March 2010, while Regulation No. 105/2010 shall apply from 1 July 2010. The new requirements will not be applicable to certain products already placed on the Community market before the respective dates. For both Regulations, the burden of proving when the products were placed on the market shall be borne by the food business operator.
