European Union (EU)* : Initiation of a Review of the Extension of the Anti-dumping Duty on Imports of Bicycles Originating in the Mainland of China to Imports of Certain Bicycle Parts from the Mainland of China

Further to Commercial Information Circular No. 455/2006 of 15 November 2006, the European Commission (the Commission) has published a notice to initiate a review of the extension of the anti-dumping duty imposed on imports of bicycles originating in the Mainland of China to imports of certain bicycle parts from the Mainland. A copy of the notice is at Annex (pdf format) for reference.

DETAILS

Grounds for the Review

  1. Since the extension of the measures to imports of certain bicycle parts, the Commission has granted requests for exemption from the extended measures to a large number of companies based in the Community. The Commission has continued to receive requests for an exemption from the extended measures and the current number of parties requesting an exemption is significant. At the same time there are no apparent indications of circumvention practices by companies having been granted an exemption.
     
  2. Furthermore, the Commission has at its disposal sufficient prima facie evidence that if the extension of the measures on imports of bicycles to imports of certain bicycle parts was removed, there would be no continuation or recurrence of circumvention practices. The Commission has decided to initiate a review to assess the need for the continuation of the extension of the anti-dumping measures.

Review Procedures

  1. Salient points of the review are set out below-
(a) Date of Publication of the Notice : 28 November 2006
(b) Product Coverage : Essential bicycle parts, as set out in para. 1 in the Commission's notice.
(c) Procedures : In view of the apparent large number of parties involved in the review investigation, the Commission may apply sampling. To enable the Commission to select a sample, all Community producers/assemblers of bicycles are requested to provide information on their company or companies as set out in para. 4(a) (i) in the Commission's notice. Such information should reach the Commission within 15 days from 28 November 2006. All interested parties wishing to submit relevant information regarding the selection of the sample must do so within 21 days from 28 November 2006. The Commission intends to make the final selection of the sample after having consulted the parties concerned that have expressed their willingness to be included in the sample.

 In order to obtain the information it deems necessary for its investigation, the Commission will send questionnaires to the sampled Community producers/assemblers of bicycles in the Community. Sampled parties must reply to the questionnaires within 37 days from the date of the notification of their inclusion in the sample.

All interested parties, if their representations are to be taken into account, must make themselves known by contacting the Commission, present their views and submit questionnaire replies or any other information within 40 days from 28 November 2006, unless otherwise specified. They may also apply to be heard by the Commission within 40 days from 28 November 2006.

(d) Investigation Schedule : Investigation will be concluded within 15 months from 28 November 2006.

BACKGROUND

  1. Definitive ant-dumping duty on imports of bicycles originating in the Mainland of China has been imposed since 10 September 1993. Based on the findings of a circumvention investigation, the Council of the EU extended with effect from 19 January 1997 the definitive anti-dumping duty imposed on imports of bicycles to imports of certain bicycle parts originating in the Mainland. Subsequent to an interim review, the subject anti-dumping duty has been increased to 48.5% and imposed for a new five-year term starting from 15 July 2005. Bicycle assemblers in the EU could however request for exemption from the extended anti-dumping measures if they could prove, among other things, that their assembly operations did not circumvent the EU's anti-dumping duty imposed on bicycles originating in the Mainland.
