European Union (EU)* : Termination of the Partial Interim Review of the Anti-dumping Measures on Imports of Bicycles Originating in the Mainland of China

Further to Commercial Information Circular No. 19/2006 of 10 January 2006, the Council of the EU (the Council) has published a regulation to terminate the partial interim review of the anti-dumping measures imposed on imports of bicycles originating in the Mainland of China. A copy of the regulation is at Annex (pdf format) for reference.

DETAILS

  1. The European Commission (the Commission) decided on its own initiative to initiate a partial interim review on 10 January 2006 concerning one Mainland company, Giant China Co. Ltd. (the company). The review was initiated with a view to determine whether the company operated under market economy conditions or alternatively whether the company fulfilled the requirements to have an individual duty.
  2. The company and its related company submitted claims for market economy treatment. During the investigation it was found that the company was related to another manufacturer of the product concerned in the Mainland which did not submit a claim for market economy treatment within the deadline set by the Commission. Consequently it could not be established that the group of companies, as a whole, fulfilled all the conditions for market economy treatment. Furthermore no determination as to whether the company fulfilled the requirements to have an individual duty could be made as the facts available to the Commission did not allow for such a determination. In the light of the above, the Council decided that the partial interim review concerning the company be terminated and the anti-dumping measures currently in force with regard to the company be maintained.

BACKGROUND

  1. Definitive anti-dumping duty on imports of bicycles originating in the Mainland of China has been imposed since 10 September 1993 at a rate of 30.6% of the net, free-at-Community-frontier price before duty and extended for another five years since 15 July 2000 consequent to an expiry review. Subsequent to an interim review, the subject anti-dumping duties have been increased to 48.5% and imposed for a new five-year term starting from 15 July 2005.
