Commercial Information Circular No. 359/2006

European Union (EU)* : Restrictions on the Marketing and Use of Certain Dangerous Substances and Preparations

The European Parliament and the Council of the EU have adopted a Directive to control the marketing and use of certain carcinogens, mutagens and substances and preparations toxic to reproduction. The aim of the Directive is to improve health protection and consumer safety. Details are set out in Directive 2005/90/EC (the Directive), copy (pdf format) of which is attached to this circular for reference.

  2. Under the Directive, the identification, classification and labelling of certain substances is updated under paragraph 1 of the Annex to the Directive. Some other chemicals classified by the EU authorities as carcinogenic, mutagenic or toxic to reproduction may also not be used in substances and preparations placed on the market for sale to the general public in individual concentration exceeding certain prescribed limits. A list of such chemicals is set out under paragraphs 2 to 6 of the Annex (pdf format) to the Directive. Member States are required to put into effect the provisions of the Directive from 24 August 2007.
