European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 274/2005 of 23 July 2005, the European Commission (the Commission) has published a notice to initiate a partial interim review of the anti-dumping measures imposed on imports of hand pallet trucks and their essential parts originating in the mainland of China. DETAILS

Grounds for the Review

  1. The Commission has decided on its own initiative to initiate a partial interim review on 31 May 2006. The review is limited in scope to dumping aspects concerning Ningbo Ruyi Joint Stock Co., Ltd. (the company), an exporter from the mainland of China. There is sufficient evidence available to the Commission that the circumstances on the basis of which the existing measures were established have changed and that these changes are of a lasting nature. The information at the Commission's disposal indicates that the company fulfils the criteria to grant for market economy status. Furthermore, a comparison of normal value based on the company's own cost/domestic prices and its export prices would lead to a reduction of dumping significantly below the level of the current anti-dumping measures.

Review Procedure

  1. Salient points of the partial interim review are set out below-
(a) Date of Publication of the Notice of Initiation : 31 May 2006
(b) Product Coverage : Hand pallet trucks and their essential parts, i.e. chassis and hydraulics, falling within CN codes ex 8427 90 00 and ex 8431 20 00 (these CN codes are given for information only).
(c) Procedures :  In order to obtain information for the investigation, the Commission will send questionnaires as well as market economy status claim forms to the company and the authorities of the mainland of China. 

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission, and also apply to be heard by the Commission within 40 days from 31 May 2006, unless otherwise specified

The company's duly substantiated claims for market economy status must reach the Commission within 15 days from 31 May 2006.

Background

  1. Definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the mainland of China has been imposed since 22 July 2005 at a rate of 46.7% of the net, free-at-Community-frontier price before duty (except for four companies with individual duty rates ranging from 7.6% to 39.9%).
