European Union (EU)* : Extension of the Definitive Anti-dumping Duty Imposed on Imports of Certain Tube or Pipe Fittings of Iron or Steel Originating in the Mainland of China to Imports of the Same Products Consigned from the Philippines, Whether Declared as Originating in the Philippines or Not

Further to Commercial Information Circular No. 309/2005 of 6 August 2005, the Council of the EU (the Council) has published a regulation to extend the definitive anti-dumping duty imposed on imports of certain tube or pipe fittings of iron or steel originating in the mainland of China to imports of the same products consigned from the Philippines, whether declared as originating in the Philippines or not. The European Commission (the Commission) published a regulation on 5 August 2005 to initiate an investigation into the alleged circumvention of anti-dumping measures imposed on imports of certain tube or pipe fittings of iron or steel originating in the mainland of China by imports of the same products consigned from the Philippines.

Based on the findings of the circumvention investigation, the Council has decided that with effect from 30 April 2006, the definitive anti-dumping duty imposed on imports of certain tube or pipe fittings (other than cast fittings, flanges and threaded fittings), of iron or steel (not including stainless steel), with a greatest external diameter not exceeding 609.6mm, of a kind used for butt-welding or other purposes, falling within CN codes ex 7307 93 11 (TARIC code 7307 93 11 99), ex 7307 93 19 (TARIC code 7307 93 19 99), ex 7307 99 30 (TARIC code 7307 99 30 98) and ex 7307 99 90 (TARIC code 7307 99 90 98), is extended to imports of the same products consigned from the Philippines, whether declared as originating in the Philippines or not (TARIC codes 7307 93 11 95, 7307 93 19 95, 7307 99 30 95 and 7307 99 90 95).

Exporters concerned which intend to lodge a request for an exemption from the extended anti-dumping duty are required to complete a questionnaire in order to enable the Commission to determine whether an exemption may be warranted. Requests for exemption should be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. The request must be sent to the following address:

  5. With the extension of the anti-dumping duty, the registration requirement of imports of certain tube or pipe fittings of iron or steel consigned from the Philippines, whether declared as originating in the Philippines or not, is discontinued.
     
  6. Definitive anti-dumping duty on imports of certain tube or pipe fittings of iron or steel originating in, inter alia, the mainland of China has been imposed since 4 April 1996. The rate of duty is 58.6% of the net, free-at-Community-frontier price before duty. Consequent to an expiry review, the duty has been extended for another five years since 7 June 2003.
